01. Acceptance & Service Scope

By accessing dandyhi.dev, entering into an engineering contract, or deploying software components authored by Dandy Tech, you agree to be bound by these Terms. Our engineering practice encompasses:

• Autonomous AI & Agentic Systems: Development of Model Context Protocol (MCP) servers, autonomous tool-use workflows, and Claude Sonnet reasoning pipelines.
• AI API Gateways & Routing Systems: Multi-LLM load balancers (NexusRouter), automated token rotation, failover mechanics, and high-throughput proxies.
• Neural Search & Grounding Systems: Integration of semantic indexing (Exa AI) and zero-hallucination contextual retrieval backends.
• Production Full-Stack Engineering: High-performance web applications, enterprise academic management portals, and digital commerce systems.

03. Third-Party Foundation Models & SLA Disclaimers

Dandy Tech builds integration architecture upon world-class foundation models (including Anthropic Claude, xAI Grok, and Exa AI). Clients acknowledge and agree that:

• Upstream Model Availability: Dandy Tech does not host upstream neural model weights directly and cannot guarantee 100% uptime of third-party model APIs, latency fluctuations caused by cloud GPU availability, or breaking deprecations instituted by foundation model providers.
• Probabilistic Reasoning & Hallucinations: While our systems incorporate rigorous validation, schema constraints, and grounding layers (Exa search + Zod runtime guards), large language models are inherently probabilistic. Clients remain responsible for human-in-the-loop review of mission-critical business decisions.
• Direct Provider Billing: Unless expressly structured as a managed service, foundation model API usage fees are billed directly by the respective provider (Anthropic, xAI, Exa, Vercel) under client-owned API accounts.

04. Acceptable Use & Anti-Abuse Policy

Clients and users of Dandy Tech infrastructure (including API endpoints, MCP servers, and public demo applications) agree not to:

• Utilize the services for unlawful, abusive, defamatory, or fraudulent purposes.
• Attempt to circumvent API quota limits, bypass authentication mechanisms, or execute denial-of-service (DoS) attacks against our proxy nodes.
• Deploy systems that violate Anthropic's Acceptable Use Policy or generate synthetic harmful material.

05. Limitation of Liability

To the maximum extent permitted by applicable law, Dandy Tech, its founder, and engineering contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data corruption, business interruption, or upstream AI service outages. In all circumstances, our aggregate liability shall not exceed the total fees paid by the client under the applicable statement of work in the three (3) months preceding the claim.

06. Governing Law & Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of Indonesia. The parties agree to resolve disputes amicably through good-faith technical negotiation; failing which, disputes shall be submitted to the exclusive jurisdiction of the district courts of Jakarta, Indonesia.
